DEI: Legal or Illegal?

Prior to the Supreme Court’s 2023 affirmative action decision, some predicted that this ruling to ban the practice would “take down” the diversity industry or deliver a “concussive” blow to workplace diversity and inclusion efforts. After the court effectively abolished race-conscious college admissions, some voices doubled down, declaring that “all DEI programs” were now “illegal.” Not so fast. The courts have left plenty of room to continue advancing diversity and inclusion in the workplace, the main focus of DEI-related litigation today.
In our webinar, we analyze the DEI landscape and the ongoing challenges that confront diversity, equity, and inclusion efforts. We will answer our webinar’s central question, is DEI legal or illegal, by examining many sources, such as court rulings, federal regulations, US Department of Justice DEI investigatory findings, executive orders, guidance, and private sector decisions to cancel or continue their existing DEI programs.
